I ended up getting another MDX with less miles just $1000 difference

Got the answer of my own question since the seller did not know jack about the car(all they want to sell), previous owner complaint of seeing water inside the car when it rains. thats all the paper said inside the car.

who knows what was wrong , only the person working on it
